Rights

All rights to the art created, including commissions, belong exclusively to me, the Artist. You may neither sell nor exchange my art in any form, physical or digital, print or NFT, under any circumstances unless you have my express written permission AND you have paid for the rights to do so. You may not use my art in any published material, even free material, on any online or physical marketplace. 

Putting my artwork into any AI engine is prohibited.

Unless exclusive rights are purchased, I retain all rights to use and monetize my art in any way I choose. This includes the sale of prints, online sales, marketing, published materials, or any other merchandise.

Commercial Rights

A commercial license is needed for the Client to use the artwork for commercial purposes. This typically includes:

• Merchandise: Using the artwork on products like prints, t-shirts, posters, etc., that will be sold.

• Advertising and Marketing: Using the artwork in social media, websites, advertisements, and other marketing materials that promote a business or product.

• Book covers and Illustrations: Using the artwork in books, or other publications that will be sold.

Exclusive Commercial License: Adds 80% to the base price of the artwork. The Client is the only one who can use the artwork commercially. The Artist cannot sell or license the artwork for any other commercial use.

Non-exclusive License: Adds 40% to the base price of the artwork. Both the Artist and Client will be allowed to use, distribute and sell the artwork commercially.

Payment

All prices are listed in USD.

A deposit of 50% (NON-REFUNDABLE) must be paid before the start of the project.

The remaining balance must be paid when the project is completed. Final images will not be released until the final full payment has been cleared.

All payments are invoiced through PayPal.

Payment plans can be arranged for larger commissions; ask me for details if necessary. 

Refund

If the Client needs to cancel the commission after paying the 50% deposit but BEFORE the sketch has been approved, I can give a partial refund (I will keep 25% of the total cost minimum).

In the rare event I am unable to complete the Client’s project, I can give a partial refund depending on the amount of work completed (I will keep 25% of the total cost minimum).

Workflow

1. Initial Inquiry -  Client to reach out with a description of the project, character(s), and any applicable details to add on or are important to the client. 

2. Pricing - I will review your idea and provide a quote and rough timeline based on all details provided.

3. Quote Approval - If the Client approves the quote and deadline provided, a 50% deposit is required to begin work.

4. Sketch Phase - I will make initial sketches based on your project brief, the Client will have the opportunity to make large changes and alterations during this phase at no extra charge.

5. Flat Color Phase - After the final sketch is approved by the Client, I will begin blocking in the base colors. I will share a work in progress at the end of this phase for the Client to review. Minor corrections and alterations can be made.

6. Render Phase - Once flat colors are approved, then I will begin the render process (adding light, shadow, special effects, etc.).

7. Final Payment - After the render phase is completed, the client needs to pay the remaining 50% of their quoted price, plus any additional fees that incurred in the flat color phase.

8. Final Image - Once final payment is cleared, I will send the high resolution image via WeTransfer as a JPG with watermarks removed.

Progress Updates

I will provide progress images throughout my workflow. All progress images will be low resolution and will contain watermarks.

Corrections/Revisions

The Client will have the opportunity to make large structural changes and alterations during the sketch phase (figure position, general composition, etc.) at no extra charge.

Once the project has moved to the flat color and render phase, the Client can make minor adjustments (skin/hair tone, general color schemes, lighting, etc.) at no extra charge.

If the Client wishes to make large changes or alterations in the flat color and render phase, this will incur additional fees depending on the complexity of the request.

Retention of Images and Files

I will retain files for one calendar year upon the completion of a project. After one year, those files may be removed and deleted.

Disclaimers

All articles of this Terms of Service are applicable unless specifically outlined within the final written agreement between Client and Artist.

The Artist retains the right to refuse service to the Client for any reason.
